KZG reserves the right to investigate and prosecute violations of these Terms to the fullest extent permitted by law. KZG may involve and cooperate with law enforcement authorities in prosecuting users who violate these Terms.

While KZG strives to provide a reliable and continuously available Service, you acknowledge and agree that:

• The Service may be temporarily unavailable due to scheduled maintenance, updates, or upgrades. KZG will make reasonable efforts to provide advance notice of scheduled maintenance when feasible, though such notice is not guaranteed.
• The Service may experience unscheduled downtime, interruptions, or service degradation due to factors beyond KZG's reasonable control, including but not limited to: third-party service disruptions, network outages, hardware failures, software bugs, cyberattacks, natural disasters, or force majeure events.
• Service availability and performance depend upon the availability and reliability of third-party infrastructure providers, including Cloudflare. KZG is not responsible for downtime, service interruptions, or performance degradation caused by third-party services.
• KZG does not guarantee uninterrupted, secure, or error-free operation of the Service. The Service is provided on an "as is" and "as available" basis.
• KZG reserves the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, for any reason, including but not limited to maintenance, updates, or business decisions.

KZG SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, OR INCONVENIENCE ARISING FROM SERVICE INTERRUPTIONS, DOWNTIME, OR UNAVAILABILITY, WHETHER CAUSED BY KZG'S ACTIONS, THIRD-PARTY SERVICE FAILURES, OR ANY OTHER REASON.

• Cloudflare, Inc.:The Service is hosted on and utilizes Cloudflare's infrastructure, including Cloudflare Pages for web hosting, Cloudflare Workers for serverless computing, Cloudflare Zaraz for tag management and analytics processing, and Cloudflare's content delivery network (CDN) and security services. All data processed through Cloudflare is subject to Cloudflare's privacy policy and terms of service.

8.2 Analytics and Tracking Services

• Google Analytics 4: The Service may utilize Google Analytics 4 for web analytics and usage tracking, subject to your explicit consent as described in our Privacy Policy. Analytics data is processed through Cloudflare Zaraz before being forwarded to Google Analytics, with IP addresses anonymized and ad personalization disabled.
• Cloudflare Zaraz: Used for server-side tag management and privacy-first analytics processing. Zaraz processes user interaction events before forwarding to analytics providers.

Disclaimer of Third-Party Services:KZG does not operate, control, or endorse any of these third-party services. The availability, accuracy, reliability, and content of third-party services are beyond KZG's control. KZG makes no representations or warranties regarding third-party services and shall not be liable for any damages, losses, or issues arising from your use of or reliance upon any third-party service.

Your use of third-party services is subject to the respective terms of service, privacy policies, and end-user license agreements of each third-party provider. KZG strongly encourages you to review the terms and privacy policies of all third-party services that may be accessed through or integrated with the Service.

9. Disclaimers of Warranties

• Warranties of Non-Infringement: Any warranty that the Service does not infringe upon the intellectual property or other rights of third parties

• Loss of data, information, or content, including but not limited to user preferences or cached information

• Business interruption, loss of business opportunities, or loss of goodwill

To the maximum extent permitted by applicable law, the total aggregate liability of the KZG Parties to you for all claims arising out of or relating to the use of or inability to use the Service, regardless of the form of action, whether in contract, tort, or otherwise, shall not exceed the amount you paid to KZG for access to the Service in the twelve (12) months preceding the event giving rise to the claim, or if you have not paid any amounts to KZG, the total liability shall not exceed one hundred Australian dollars (AUD $100.00).

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. In such jurisdictions, the liability of the KZG Parties shall be limited to the maximum extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless the KZG Parties from and against any and all claims, demands, actions, suits, proceedings, liabilities, damages, losses, costs, and expenses (including, without limitation, reasonable attorneys' fees, court costs, and settlement amounts) arising out of or relating to:

• Your use of or access to the Service, including any data or content transmitted or received by you
• Your violation of these Terms or any applicable law, rule, or regulation
• Your violation of any third-party right, including without limitation any intellectual property right, privacy right, or publicity right
• Any claim that your use of the Service caused damage to a third party
• Your violation of any applicable data protection or privacy laws
• Any fraudulent, illegal, or unauthorized use of the Service by you or any person using your device or network connection
• Any content, data, or information that you submit, post, transmit, or make available through the Service

This indemnification obligation will survive the termination of these Terms and your use of the Service. KZG reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with KZG in asserting any available defenses. You agree not to settle any matter without the prior written consent of KZG.

KZG reserves the right, in its sole discretion and without prior notice or liability, to suspend, restrict, or terminate your access to the Service, in whole or in part, at any time and for any reason, including but not limited to:

• Engagement in fraudulent, illegal, or unauthorized activity
• Abuse, misuse, or excessive use of the Service, including but not limited to: excessive automated requests, denial of service attacks, scraping or data harvesting that interferes with Service operations, or any activity that degrades Service performance or availability (note: the Service is a static website with no user accounts, so termination primarily relates to blocking access via technical means)
• Infringement of intellectual property rights or other rights of KZG or third parties
• Any conduct that KZG, in its sole discretion, determines to be harmful to other users, KZG, or third parties
• Discontinuation or material modification of the Service or any part thereof
• Extended periods of inactivity or non-use of the Service

Upon termination or suspension of your access to the Service:

• Your right to access and use the Service will immediately cease
• KZG may, but is not obligated to, delete or retain any data, information, or content associated with your use of the Service, in accordance with our Privacy Policy and applicable data retention policies
• All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability

You may discontinue your use of the Service at any time by simply ceasing to access the Website. KZG may also terminate or suspend the Service in its entirety, or any portion thereof, at any time, with or without notice, for any reason or no reason.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law principles or provisions. Any legal action or proceeding arising under or relating to these Terms or the Service shall be brought exclusively in the courts of Victoria, Australia, and you hereby consent to the personal jurisdiction and venue of such courts.

If you are accessing the Service from outside Australia, you are responsible for compliance with local laws. KZG makes no representation that the Service or any content is appropriate or available for use in locations outside Australia, and accessing the Service from territories where such access is illegal is prohibited.
